Virginia determines the amount of required child support by applying the “Virginia Child Support Guidelines.” Our state assumes that both parents will be “fairly sharing” the cost of raising their children and the guidelines provide a formula for estimating child support. Child support payments are based on the total income of both parents, the number of children the parents have together, the percentage that each parent contributes to the total income, and the child custody arrangement (sole custody, shared custody, split custody, etc.) that is decided upon by the Court. It is presumed by the Court that the amount of support recommended by the guidelines is correct and fair to both parents. However, in certain cases, a child support payment amount may not be fair to one or both parents due to unusual circumstances. Having an attorney who can effectively argue for a fair child support amount can make the difference in how the Judge rules.
